IMPORTANT - BEFORE INSTALLING, ACCESSING, OR USING ANY PART OF THE FIREARSON.ORG, YOU SHOULD READ THE FOLLOWING TERMS AND CONDITIONS CONTAINED IN THIS TERMS OF USE AGREEMENT (THE “TOU”) CAREFULLY AS THEY GOVERN YOUR ACCESS TO AND USE OF THESE SITES AND ANY PROGRAMS, SERVICES, PRODUCTS, MATERIALS, AND INFORMATION AVAILABLE THROUGH THESE SITES OR USED IN CONNECTION THEREWITH (THE FOREGOING COLLECTIVELY REFERENCED HEREIN AS THE “SITES”). IF YOU DO NOT AGREE WITH THIS TOU, YOU ARE NOT GRANTED PERMISSION BY IAAI TO ACCESS OR OTHERWISE USE ANY SITE AND ARE INSTRUCTED TO EXIT THE SITES IMMEDIATELY.

The following constitutes the "Terms and Conditions" under which you may use the International Association of Arson Investigators (IAAI) website. The terms “IAAI,” “Association,” “The International” or “Our” refer to the International Association of Arson Investigators. The terms "You" and "User" refer to all companies, individuals and/or entities accessing IAAI websites for any reason.
Websites owned and operated by the IAAI are sometimes collectively referred to as "IAAI Website", “IAAI Websites,” “Association Website,” “Website” or “Site.” These domains include but are not limited to the following: firearson.com, CFITrainer.net, and iaaievidenceguide.com.
By using IAAI websites and services, you are indicating your acceptance to be bound by these terms and conditions. IAAI (the "Association") may revise these terms and conditions at any time by updating this document.
IAAI shall have the right, at its sole discretion, to modify, or remove any terms or conditions of these terms of use without notice. Any changes to these terms of use shall be effective immediately following the posting of such changes on this website. The most recent version of these terms of use may always be found at www.firearson.com. You agree to review these terms of use and agree that any subsequent use by you of this website following changes to these terms of use shall constitute your acceptance of all such changes.

IAAI reserves the right to accept or reject any advertisement submitted for IAAI’s publications and on its websites. The appearance of advertising in IAAI’s publications and on its websites in no way implies endorsement or approval by IAAI of any advertising claims or of the advertiser, its product, or services. IAAI disclaims any liability whatsoever in connection with advertising appearing in IAAI’s publications and on its websites.
Social Media Content Disclaimer
IAAI does not guarantee the truthfulness, accuracy, or validity of any comments posted to its social media outlets (blogs, social networks, message boards/forums, etc.). Users may not post any content that is obscene, defamatory, profane, libelous, threatening, harassing, abusive, hateful, or embarrassing to any person or entity. IAAI reserves the right to delete or edit any comments that it considers inappropriate or unacceptable. By submitting a comment, users expressly grant IAAI a worldwide, non-exclusive, royalty-free, irrevocable license to publish, modify, reproduce, display, distribute, and use such content for any purpose without further notice or consent.
Use of Website Content
IAAI websites may be used only for lawful purposes. The use of the website content on any other website or in a networked computer environment for any purpose is prohibited without the express written permission of the Association.
The terms and conditions of use strictly prohibit downloading data or copying any information from IAAI websites for the purpose of any mass communications. Copying information with the intent to sell, distribute, imitate, advertise, or any other purpose not approved in writing by IAAI is prohibited.
The terms and conditions of use prohibit downloading or copying data for building or adding to any other database for any purpose.
Additionally, the Association specifically prohibits sharing your password with any third party or using your password for any unauthorized purpose
Acceptable Website Use
You may not use IAAI websites in order to transmit, distribute, store or destroy material, including, without limitation, website content in violation of any applicable law or regulation, in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others, or violate the privacy, publicity or other personal rights of others, or that is defamatory, obscene, threatening, abusive or hateful.
Security Rules
Users are prohibited from violating or attempting to violate the security of any IAAI website, including, without limitation, accessing data not intended for such user or logging into a server or account the user is not authorized to access, or sending unsolicited faxes or e-mail, including promotions and/or advertising of products or services.
Violations of system or network security may result in civil or criminal liability. The Association will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
IAAI Rights To User Information
To the fullest extent permitted by law, by submitting content to any public or nonpublic area of any IAAI website, you grant the Association the royalty-free, perpetual, irrevocable, sub-licensable (through multiple tiers), non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or later developed, for the full term of any rights that may exist in such content. “Content” does not include personal data or personal information that is otherwise subject to and protected under IAAI’s privacy policy.
You also permit any subscriber to access, display, or view such content for personal or business use only. Subject to the foregoing, the owner of such content placed on the website retains all rights that may exist in such content.
Registration And Password
If any services from IAAI require you to open an account or make changes to an existing account, you must complete the registration/update process by providing us with current, complete, and accurate information. You may also be required to choose or update a password and/or username.
You are responsible for maintaining the accuracy and content of your information and confidentiality of your password(s). Furthermore, you are entirely responsible for all activities that occur under your account. You agree to notify IAAI immediately of any unauthorized use of your account or any other breach of security. IAAI will not be liable for any loss that you may incur because of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by IAAI or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.
Indemnification
You agree to indemnify, defend and hold harmless IAAI, its officers, directors, employees, agents and third parties, for any losses, liabilities and expenses (including reasonable attorney fees) relating to or arising out of your use of or inability to use the site or services, any user postings made by you, your violations of any terms of this agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. IAAI reserves the right, at it ss own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with IAAI in asserting any available defenses.
The Association does not warrant that any information will operate error-free or that any IAAI website and its servers operate error-free. If your use of any IAAI provided content results in the need for servicing or replacing equipment or data, the Association is not responsible for those costs. The IAAI content and user provided content are provided on an "as is" basis without any warranties of any kind. The Association, to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for particular purpose and non-infringement. The Association makes no warranties about the accuracy, reliability, completeness, or timeliness of the content, services, software, text, graphics, and links. In no event shall the Association, its suppliers or any third parties mentioned on any IAAI website be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use any IAAI content, whether based on warranty, contract, tort or any other legal theory, and whether or not the association is advised of the possibility of such damages.
If you are a California resident, you waive California Civil Code d1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
No Resale Or Unauthorized Commercial Use
IAAI websites contain links to third-party websites. These links are provided solely as a convenience that may bring value to your business.
The Association is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party websites. If you decide to access linked third-party websites, you do so at your own risk.
Limitation Of Liability
IAAI's maximum liability arising out of or in connection with any IAAI site or your use of the website content, regardless of the cause of action (whether in contract, tort, breach of warranty or otherwise), will not exceed $100.
Termination
The Association reserves the right, at its sole discretion, to pursue all of its legal remedies, including, but not limited to immediate termination of your account along with your ability to access IAAI websites and/or any other service provided to you by the Association, upon any breach by you of these terms and conditions or if the Association is unable to verify or authenticate any information you submit to a IAAI website.
Indemnity
You agree to defend, indemnify and hold harmless the Association, its officers, directors, employees and agents from and against any claims, actions or demands, including, without limitation, reasonable legal and accounting fees, alleging or resulting from any material you provide to an IAAI website, any website content that you use or your breach of the terms of these terms and conditions. The Association shall provide notice to you promptly of any such claim, suit or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.
General
The IAAI website is controlled, operated, and administered by IAAI from our offices within the United States. If you access the service from a location outside the United States, you are responsible for compliance with all local laws. You agree that you will not use the IAAI site content accessed through IAAI in any country or in any manner prohibited by any applicable laws, restrictions, or regulations. If you access the Website from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
These Terms and Conditions are governed by the internal substantive laws of the State of Maryland without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Maryland.
If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect. No waiver of any term of these terms and conditions shall be deemed a further or continuing waiver of such term or any other term.
Except as expressly provided in additional terms of use for areas of the website, a particular "Legal Notice" or Software License or material on particular web pages, these terms and conditions constitute the entire agreement between you and the Association with respect to the use of website. No changes to these terms and conditions shall be made except by a revised posting on this page.
Additional Terms Of Use
Certain areas of the website and the other IAAI websites may be subject to additional terms of use. By using such areas, or any part thereof, you agree to be bound by the additional terms of use applicable to such areas.
